1My society has signed DA with developer in 2023 but developer is not executing PAAA what to do? Building is demolished and construction in progress at 1st floor.DA is just a contract for the implementation of the Project as a whole and will come to an end when the Project is over, whereas PAAA is the only document which will establish your right as the owner of your New Flat in future.
2How much time does it normally take from receipt of IOD to receipt of CC?Under normal circumstances, the period from IOD to First CC may be 3 to 5 months which also includes the period for vacating existing flats and demolition of the existing building. However, if your project requires clearance from Ministry of Environment, Forest and Climate Change (MoEFCC) called "environmental clearance", this period may be much longer.
3Our builder has failed to obtain OC and has gone to jail, and a Society has been formed by flat purchasers who have now taken over the project and the Society is applying for deemed conveyance through a consultant.

Could you please advise on the process for the Society to apply for the OC? What are the likely timelines to get it?
Since you have mentioned that the purchasers have formed a Society and Conveyance is still not done, I presume it is a greenfield project. Since you are talking about obtaining OC, I presume the construction work is nearing completion. This answer is based on these presumptions.

Before taking any concrete steps, you need to ensure that the purchasers are legally entitled to take over the project, have secured the NOC from the earlier Architect (through a court order etc) and the new Society is legally formed. Then you may proceed as follows:

1. First you raise some provisional funds from the purchasers and engage a Liaison Architect and Construction/ Project Management Consultant (PMC) on your behalf to ascertain the current status of the project from statutory angle (approvals etc) and completion angle (quality and extent of work completed). They should prepare a list of balance works as well as any deviations from the approved plans, structural specifications, quality etc. They should also prepare an estimate of cost to complete the balance work and rectify deviations, if any.

2. Then you collectively raise additional funds from the purchasers and appoint a contractor to complete the balance work and rectify deviations, if any. You may appoint the contractor through a barter system (trading flats for the cost) if the cost is high.

3. Once the construction work is completed in all respects and is in accordance with the approved plans, you may apply for Occupancy Certificate (OC) through your newly appointed Liaison Architect.

If all compliances are in order and if there are no new legal issues with the earlier developer, this process may take about 6 months from the date of application for OC.
