Legal Documentation:
Now that you have selected a Developer, you shall issue a Letter of Intent (LOI) to him and jointly undertake some preliminary tasks such to confirm the FSI Potential of the Plot, finalize lists of Internal, Common and Built Amenities etc. Thereafter, you shall enter into Legal Documentation with the Developer so that he is legally empowered to execute your Project. The important steps in this process are as follows:

1. Dev shall confirm Legal Title of the Plot
2. Dev shall confirm the FSI Potential of the Plot
3. Drafts of DA, PoA & PAAA shall be approved in SGBM
4. Society & Developer shall execute DA
5. Dev shall Pay Stamp Duty
6. Soc and Dev shall Register DA
7. Soc shall issue PoA to Developer

Draft of DA shall be prepared in line with the provisions of Tender Documents. It may take a few rounds of joint discussions before the same is finalized. Once DA is registered and PoA is received, the Developer shall be legally entitled to represent and act on behalf of the Society for your RD Project.

Plans & Approvals/ Permissions:
Generally, the process of approval of Plans is mentioned in the Tender Documents. Plans need to be first approved by the Members before they are submitted to Approving Authority for statutory approval and permissions. Quite often, Dev’s Architect prepares plans soon after Dev’s selection and the process goes on simultaneously with Legal Documentation. The important steps in this process are as follows:

Vacating Units:
Once the plans are approved by the Statutory Authorities and Permissions are obtained, you should get ready to vacate your existing units. But before that the Developer is required to discharge some obligations and fulfil some conditions as per the terms of DA. The important steps in this process are as follows:
